SCOPE OF APPLICATION
These Terms and Conditions of Sale ("Terms") apply to all purchases made through this website.
By placing an order, the customer acknowledges having read, understood, and accepted these Terms without reservation.
PRODUCTS
KOLD designs and sells ski and snowboard goggles and related accessories.
Product descriptions, specifications, images and technical information are provided as accurately as possible. Minor variations in color, appearance or finish may occur due to screen settings, lighting conditions or manufacturing tolerances.
All products sold through this website are new.
PRODUCT USE
KOLD goggles are intended exclusively for skiing and snowboarding activities.
Customers are responsible for using the products appropriately and in accordance with their intended purpose.
KOLD products are not designed to replace certified protective equipment and should not be relied upon as a safety device beyond their intended function as ski and snowboard eyewear.
AVAILABILITY
All products are offered subject to availability.
In the event that a product becomes unavailable after an order has been placed, the customer will be informed as soon as possible and offered either a refund or an alternative solution where available.
PRICES
Prices are displayed in Euros (€) and include all applicable taxes unless otherwise stated.
Shipping costs are displayed separately before order confirmation.
KOLD reserves the right to modify prices at any time. The price charged will be the one displayed at the time of purchase.
ORDERS
An order is considered final once payment has been successfully processed.
KOLD reserves the right to refuse or cancel any order in the event of:

PAYMENT
Accepted payment methods are those displayed at checkout.
Payment is due immediately upon order confirmation.
No order will be shipped before full payment has been received.
SHIPPING & DELIVERY
Orders are shipped from France to destinations worldwide.
Complimentary shipping is offered on orders of €179 or more. Shipping fees for orders below this threshold are displayed during checkout.
Delivery times are estimates only and may vary depending on destination, customs procedures and shipping carriers.
KOLD shall not be held responsible for delays caused by shipping carriers, customs authorities or events beyond its reasonable control.
The risk of loss or damage transfers to the customer upon delivery of the order.
For international shipments outside the European Union, customers may be responsible for customs duties, import taxes and related fees imposed by local authorities.
RIGHT OF WITHDRAWAL
Customers residing in jurisdictions where consumer protection laws provide a right of withdrawal may return their order within fourteen (14) days of receiving the goods without providing any reason.
To exercise this right, customers must notify KOLD by email before the expiration of the withdrawal period.
Returned products must comply with the conditions outlined in the Returns Policy below.
RETURNS
Products may be returned within fourteen (14) days of delivery.
To be eligible for a return:

Products must include all accessories, lenses, cases, pouches and documentation provided with the original order

Products must show no signs of wear, damage or misuse
Return shipping costs are the responsibility of the customer.
KOLD reserves the right to refuse any return that does not comply with these conditions.
REFUNDS
Refunds are issued only after the returned products have been received and inspected.
If approved, refunds will be processed within fourteen (14) days using the original payment method.
Original shipping charges are non-refundable unless required by applicable law.
WARRANTY
KOLD products are covered by a one (1) year limited warranty from the date of delivery.
The warranty covers manufacturing defects in materials or workmanship under normal use.
The warranty does not cover:

Scratches to lenses

Accidental damage

Improper use or storage

Unauthorized modifications or repairs

Damage resulting from misuse or negligence
Any warranty claim must be accompanied by proof of purchase and supporting photographs where requested.
KOLD reserves the right to repair, replace or refund the product at its sole discretion.
DAMAGED OR INCORRECT ITEMS
Customers must inspect their order upon receipt.
Any claim relating to an incorrect item or damage sustained during shipping must be reported within forty-eight (48) hours of delivery and accompanied by photographic evidence.
Failure to notify KOLD within this period may result in the claim being refused.
LIABILITY
To the fullest extent permitted by law, KOLD shall not be held liable for:

Nothing in these Terms excludes liability that cannot be excluded under applicable law.
INTELLECTUAL PROPERTY
All content available on this website, including but not limited to texts, photographs, graphics, logos, product designs and visual materials, is the exclusive property of KOLD and may not be reproduced, distributed or used without prior written consent.
PERSONAL DATA
Personal data is processed in accordance with the Privacy Policy and applicable data protection regulations, including the General Data Protection Regulation (GDPR).
GOVERNING LAW & DISPUTES
These Terms are governed by French law.
In the event of a dispute, both parties agree to seek an amicable solution before initiating legal proceedings.
Failing such resolution, disputes shall fall under the jurisdiction of the competent French courts.
